Welcome to Promto! These Terms and Conditions ("Terms") govern your use of the Promto mobile application ("App") developed by Orixot ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.

Important: Please read these Terms carefully before using Promto. If you do not agree with these Terms, do not use the App.

1. Acceptance of Terms

By accessing or using Promto, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must immediately stop using the App.

2. License to Use

2.1 Grant of License

We grant you a limited, non-exclusive, non-transferable, revocable license to use Promto for your personal, non-commercial purposes, subject to these Terms.

2.2 Restrictions

You agree NOT to:

Copy, modify, or create derivative works of the App
Reverse engineer, decompile, or disassemble the App
Remove any copyright or proprietary notices
Use the App for any illegal or unauthorized purpose
Attempt to gain unauthorized access to the App's systems
Distribute, sell, rent, or lease the App
Use automated systems or bots to access the App

3. User Responsibilities

3.1 Appropriate Use

You agree to use Promto responsibly and in accordance with all applicable laws and regulations. You are responsible for:

Maintaining the security of your device
All activities that occur through your use of the App
Ensuring your device meets the App's requirements
Your internet connection and any associated charges

3.2 Age Requirement

You must be at least 13 years old to use Promto. If you are under 18, you must have parental or guardian permission to use the App.

4. Content and Prompts

4.1 Prompt Library

Promto provides a curated collection of AI prompts for various platforms including ChatGPT, Gemini, and Ideogram. These prompts are provided "as is" for informational and educational purposes.

4.2 No Guarantees

We do not guarantee:

The accuracy, completeness, or usefulness of any prompts
That prompts will produce specific results on AI platforms
The availability of any particular prompt
That the App will meet your specific requirements

4.3 Third-Party Platforms

Prompts are designed for use with third-party AI platforms (ChatGPT, Gemini, Ideogram). We are not affiliated with these platforms, and your use of them is subject to their respective terms of service.

5. Intellectual Property Rights

5.1 Our Rights

All rights, title, and interest in Promto, including its design, features, functionality, and content, are owned by Orixot. This includes:

App interface and design
App code and software
Trademarks and branding
Curated prompt collection organization

5.2 Prompt Content

Individual prompts may be subject to various licenses. By using prompts from Promto, you agree to respect any applicable copyrights and intellectual property rights.

6. Advertisements

Promto displays advertisements through Google AdMob to support the free availability of the App. By using Promto, you agree to:

View advertisements as part of the App experience
The collection of data by AdMob as described in our Privacy Policy
Not interfere with or block advertisements

7. Privacy and Data

Your privacy is important to us. Our collection and use of your information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

We do not collect personal information or require accounts

8. Disclaimers and Warranties

8.1 "As Is" Basis

PROMTO IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

Warranties of merchantability
Fitness for a particular purpose
Non-infringement
Uninterrupted or error-free operation

8.2 No Professional Advice

Promto does not provide professional advice. Prompts are for informational purposes only and should not be considered as professional, legal, financial, or technical advice.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ORIXOT SHALL NOT BE LIABLE FOR:

Any indirect, incidental, special, consequential, or punitive damages
Loss of profits, data, or business opportunities
Damages arising from your use or inability to use the App
Any results obtained from using prompts from the App
Actions taken based on information from the App

Maximum Liability: Our total liability shall not exceed the amount you paid to use the App (which is $0 for the free version).

10. Indemnification

You agree to indemnify, defend, and hold harmless Orixot and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

Your violation of these Terms
Your use of the App
Your violation of any rights of another party
Your violation of any applicable laws or regulations

11. Updates and Modifications

11.1 App Updates

We may update Promto from time to time to:

Add new features or prompts
Fix bugs and improve performance
Enhance security
Comply with legal requirements

11.2 Terms Updates

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the App after changes constitutes acceptance of the modified Terms.

12. Termination

12.1 By You

You may stop using Promto at any time by uninstalling the App from your device.

12.2 By Us

We reserve the right to:

Suspend or terminate your access to the App
Discontinue the App entirely
Remove or modify any content or features

We may do this at any time, for any reason, without notice or liability.

13. Third-Party Links and Services

Promto may contain links to third-party websites or services (ChatGPT, Gemini, Ideogram, etc.). We are not responsible for:

The content of third-party sites
Your interactions with third-party services
The privacy practices of third parties
Any damages resulting from third-party services

14. Geographic Restrictions

Promto is developed and operated from Pakistan 🇵🇰. We make no representation that the App is appropriate or available for use in other locations. Access from territories where the content is illegal is prohibited.

15. Governing Law and Disputes

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Pakistan, without regard to conflict of law principles.

15.2 Dispute Resolution

Any disputes arising from these Terms or your use of Promto shall be resolved through:

Good faith negotiation between the parties
Mediation if negotiation fails
Courts of Pakistan as a last resort

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Orixot regarding Promto and supersede all prior agreements and understandings.

18. No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
